Purchaser's exclusive remedy for any goods having defects in materials or workmanship and for any damages including consequential damages caused thereby will be a refund of the purchase price or replacement of such defective goods returned to seller within ninety (90) days after receipt thereof by the Purchaser. Purchaser may return goods to Seller for repair of defects in materials or workmanship at no charge to Purchaser for parts and/or labor for up to twelve (12) months from purchase date; appropriate shipping charges will still apply. Purchaser may return goods to seller for replacement of defective parts or material at no charge to Purchaser for up to three (3) years from purchase date; beyond twelve (12) months of purchase date labor and appropriate shipping charges will still apply. Either (i) Purchaser's failure to allow seller a reasonable opportunity to inspect, test, or sample the goods prior to their return to the Seller, or (ii) Purchaser's failure to give written notice of the defects to Seller within ninety (90) days after the receipt of goods, constitutes a waiver by Purchaser of all claims in respect to goods furnished hereunder. Warranty is valid only if the information card is returned to the manufacturer within ninety (90) days of original purchase. Warranty WILL NOT cover damages caused by misuse and/or improper care, or replacement or repair of the alkaline batteries included in shipping. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WHICH EXTEND BEYOND THE FACE HEREOF.
